We contracted with a Reputable / Established manufacture in Jiangmen China (established 2008) for about $22,000 worth of product. As part of the negotiation we were given exclusive distributorship of this product for North American Markets (contractually bound). The manufacturer provided the first 100 units as described and defined by contract for preliminary market tests, and we proceeded with a $10,000 marketing campaign. When it came time for full production, they switched the circuit boards and provided us with 500 out of 500 defective units... This cost us over $16500 in hard costs, and over $7000 in refunds.
They claimed it was a terrible mistake, and offered to replace the 500 defective units.
In good faith we accepted their offer. They sent us detailed pictures of the new replacements units and we accepted their offer to replace the units... They sent us 550 replacements (an extra 50 for good faith) of just the one defective part...
You should specify your experience level, vitae, and ideally the percentage of the recovery you'd like to receive. We anticipate the bulk of your payment to come in as a sizable percentage of the recovery...
These 550 units did not fit the existing product we had and could not integrate with the rest of the system (ie. They replaced the defective controller unit, but it didn't fit with the rest of the system)...
In good faith we paid another $2000 for replacement parts to share the burden of this costly mistake, only to discover that the 500 replacement units they had sent us were also defective at a rate of over 70%, costing us an additional $5000 in consumer side refunds.
In total: We've paid over $42,000USD and received 800 out of 1000 products to be defective.
Furthermore: This company also took our designs and sold them into the North American market in breech of contract, however, although this has been confirmed, it is difficult to document and not cornerstone of this case.
Objectives: We need a China based attorney to prepare documentation, and attempt to recover as much damages as possible.
